Divorce Including a Business
Acted for Wife where the most significant asset was the family company, the shares of which were held by her and her Husband. Successfully negotiated the divorce, obtained a Consent Order from the Court confirming the terms of the financial settlement. Additionally, liaised closely with Berry & Lamberts’ Dispute Resolution team and prepared a Shareholders’ Agreement to ensure that all matters were addressed on the client’s behalf, including tax issues and her position as an employee and Director of the Company.
Complex Financial Divorce with International Elements
Reaching agreement in proceedings before the High Court enabling client to take children abroad on holiday to a country that was not a signatory to The Hague Abduction Convention. Required seeking specialist advice from lawyers in the country concerned so that “Mirror Orders” could be drafted. Subsequently successfully negotiated financial issues, including substantial resources abroad, the UK enabling our client to receive benefits through a pension sharing order and ensuring that tax issues were properly addressed.
Divorce with a Property Portfolio and Children in Private Education
The parties held a substantial property portfolio and matters needed to be dealt with efficiently to ensure our client did not have a substantial capital gains tax liability in implementation of the terms of the financial agreement. Careful consideration was required of the law relating to non-matrimonial property which had been gifted to the client both before and during the marriage. The terms of the financial settlement ensured that the children would be able to finish their education in private schools and that funding was in place to meet the fees.
