Divorce Including a Business
Acted for the wife where the most significant asset was the family company, the shares of which were held by her and her husband. Successfully negotiated the divorce, obtained a Consent Order from the Court confirming the terms of the financial settlement. Additionally, liaised closely with Berry & Lamberts’ Dispute Resolution team and prepared a Shareholders’ Agreement to ensure that all matters were addressed on the client’s behalf, including tax issues and her position as an employee and Director of the Company.
Removal of a Co-Shareholder by Business Owner
A business owner needed assistance with removing a co-shareholder from the company. Our Dispute & Resolution team helped negotiate terms and process removal of the co-shareholder. When the business was then sold to a large international company we assisted in regularising the planning issues on the site they operated from, carrying out the due diligence exercise, negotiating the contracts and completing the deal, leading to a successful sale.
Complex Financial Divorce with International Elements
Reaching agreement in proceedings before the High Court enabling client to take children abroad on holiday to a country that was not a signatory to The Hague Abduction Convention. Required seeking specialist advice from lawyers in the country concerned so that ‘Mirror Orders’ could be drafted. Subsequently successfully negotiated financial issues, including substantial resources abroad, the UK enabling our client to receive benefits through a pension sharing order and ensuring that tax issues were properly addressed.
Divorce with a Property Portfolio and Children in Private Education
The parties held a substantial property portfolio and matters needed to be dealt with efficiently to ensure our client did not have a substantial capital gains tax liability in implementation of the terms of the financial agreement. Careful consideration was required of the law relating to non-matrimonial property which had been gifted to the client both before and during the marriage. The terms of the financial settlement ensured that the children would be able to finish their education in private schools and that funding was in place to meet the fees.
Excellent listening skills, understanding to my difficult situation.
As a client in her 80th year, I felt all the team were very kind and patient with me. The experience was less stressful than I had expected [sale and purchase]. My thanks to them all.
I would like to thank you very much for the very professional and efficient way you have dealt with my case and would not hesitate to recommend you.
