This was a leasehold sale with an increasing ground rent in the lease which was unacceptable to the buyer’s mortgage lender. As the ground rent was set to increase above £250, this could lead to potential forfeiture of the lease under The Housing Act 1988. A Deed of Variation of the lease was required to remedy the breach requiring the landlord to give the mortgage lender notice of any breach before they can commence possession proceedings.  

We had to approach the original developer landlord to vary the terms of the lease. Secondly, the client had a Help to Buy equity loan to redeem with the original Government provider and we had to work efficiently to expedite both of these issues during a pandemic to meet the parties timescales.
