Lasting Powers Of Attorney

Lasting Powers of Attorney are official documents that enable the people you trust to look after you in the future, should you become unable to make decisions due to physical or mental incapacity.

The two different types of Lasting Powers of Attorney provide you with peace of mind in respect of the management of your property and finances and decisions that might need to be made about your health and personal welfare.

If you do not have a person who you would trust to take on the responsibility of looking after you, the Partners of our firm can be appointed to act as your Attorneys, however the time spent on the management of your affairs will be chargeable at our hourly rates. Our team is experienced in the use of Powers of Attorney and we are able to offer expert advice to the donor of a Power as to the practicality of their wishes and intentions, as well as to Attorneys themselves. It is important for Attorneys to understand their role and function. We will advise in respect of common issues that arise, including gifting or disputes between Attorneys, and how to avoid them.

Our team can advise you where Enduring Powers of Attorneys fall short of today’s world and need supplementing or replacing. We can also help Attorneys with the registration of Enduring Powers of Attorney with the Office of Public Guardian and we can provide advice to donors who are concerned about the validity, scope and terms of that document. If you have been appointed as Attorney under an Enduring Power of Attorney, we can assist in the registration of the power with the Office of Public Guardian.
