How Berry and Lamberts helped:

This was a small estate including bank accounts and investments. We assisted the executor to deal with the estate and provided advice on the administration including the appropriate action and response upon the Department for Work and Pensions (DWP) informing the executor that DWP may have a claim against the estate if the deceased had received, from the DWP, incorrectly calculated benefits. The DWP asked for a list of assets in the estate to compare against those disclosed to them by the deceased.

The DWP, if they have paid a deceased means tested benefits, will often review whether those benefits were correctly awarded once Probate has been granted and they  know the value of a deceased’s estate. In this case, they concluded the benefits had been correctly awarded and there was no claim.
