If you are in a civil partnership and the relationship breaks down, you can consider applying to court for the partnership to be dissolved. You will have to wait at least one year from the date of entering the civil partnership to do this and the Court must be satisfied that one of the following four facts are proved:

  • Unreasonable behaviour
  • Two years' separation (with consent of the other party)
  • Desertion for two years
  • Five years' separation

You will receive the same financial remedy as a spouse who obtains a divorce. Financial provision can also be applied for in respect of any child or children of the family.
