We understand the difficulties that social landlords have in dealing with claims against legally aided clients.   • Possession Claims

    We have assisted social landlords in bringing claims for possession on the basis of rent arrears, nuisance, notices to quit and pursuant to demotion orders. Additionally, we have assisted in evicting trespassers from Housing Association properties.

    Antisocial Behaviour

    Through extensive experience we have become specialists in Anti-Social Behaviour cases. We recognise that a large part of a landlord’s problem is managing expectations and offering support and encouragement to those suffering antisocial behaviour. We have obtained possession orders, antisocial behaviour injunctions and demotion orders on behalf of our social landlord clients. We have dealt with committal proceedings against tenants in breach of antisocial behaviour injunctions.

    Disrepair Cases

    We assist social landlords in dealing with defence of claims for repair. We provide early advice on potential exposure whilst ensuring that claims with no merit are vigorously defended. We can advise Associations and Local Authorities in relation to their duties under s.11 of the Landlord and Tenant Act 1985 and other statutory provisions. We are also able to obtain access injunctions at a fixed price so that you are able to ensure your housing stock is protected.

    Training

    We are able to provide training to housing managers and team leaders on all aspects of housing law. We are able to cater to all needs in this respect and are quite happy to focus training on particular topics requested by our clients.

    General Housing Management

    We advise on issues relating to tenancy succession and to tenants with disabilities and have obtained injunctions to remove vehicles illegally parked on our clients’ land.

    Tenancy agreements

    It is vitally important that tenancy agreements are put in place to record the agreement between the parties at the start of the landlord and tenant relationship. Each party must be aware of their rights and obligations. We ensure these documents are prepared in a thorough and robust way to cover issues such as rights of entry, repairing obligations and termination procedures.

    Paul has been a qualified solicitor for 18 years and has spent the entirety of that time in the Commercial and Dispute Resolution department. Paul advises businesses in ownership disputes, contract disputes with suppliers and customers, employment disputes and preparing commercial contracts.

    Paul is also a specialist in Landlord and Tenant/Social Housing law and acts for Housing Associations, Private Landlords and Tenants. He deals with drafting tenancy agreements, possession actions, disrepair problems, issues involving anti-social behaviour and succession issues. Paul also deals with all types of property disputes including ownership disputes, boundary disputes, issues regarding rights of way and party walls. He has recently acted for a couple in a boundary dispute case which received coverage in the national press.

    Paul’s aim is to achieve the best result for the client for the least expense. If this outcome cannot be achieved through negotiation then Paul is able to fully prepare and assist clients in contested Court hearings.

    His recent cases include acting for a local business involved in a £14 million fraud and successfully negotiating a settlement, advising two company directors in a dispute with their co-directors upon the failing of a business and acting for a national transport manufacturer in a dispute with a customer.

    Dianne has been a member of our Dispute Resolution team for over 15 years. She qualified as a Fellow of the Institute of Legal Executives in 2000, obtained her Postgraduate Diploma in Legal Practice with distinction in 2002 and qualified as a solicitor the same year.

    Dianne has significant experience of dealing with personal injury claims and is a member of APIL (the Association of Personal Injury Lawyers).  She also advises on employment law, contract and consumer law and general dispute resolution.
