  • Acquiring your freehold

    It is becoming increasingly popular for long leaseholders to come together to purchase the freehold of their building. There can be many reasons for doing this, such as taking control of the management and maintenance of the building or in order to extend leases without payment to a third party landlord. In certain cases landlords that wish to sell the freehold of a let building must offer it to the tenants first.

    Our solicitors can act for groups of leaseholders in relation to the freehold acquisition whether it be by private agreement, under an offer notice from the landlord, or forced by statute. We also deal with ancillary work such as formation of a company to purchase the freehold and a participation agreement to formalise matters between the purchasing tenants.

    Buying and selling

    We offer a complete service for first-time buyers, including shared ownership and with Help to Buy assistance, through to specialist residences for the elderly. We are on the panels of all major lenders should you require a mortgage.

    Within the team we have expertise with new builds, leaseholds, country and rural properties, estates and high value properties, listed buildings, buy to let and let-properties, and plot sales for development.

    Equity release

    For many people their main asset is their home. Whilst they may be asset rich they are often income poor. Equity release mortgages are one possible solution although taking out such a mortgage requires careful consideration. We always recommend independent financial advice is sought prior to making any commitment.

    For those who choose this option we can guide you through the process, and ensure you fully understand all the implications, before completing the mortgage. This type of mortgage will usually require at least one face to face meeting which can be at our offices or your home if within a reasonable travelling distance of the firm. We deal only with lenders that comply with the Equity Release Council’s standards to ensure you are treated fairly and in good faith:

    Lease extensions

    Leases can be extended for many reasons, including:

    • to meet the lender minimum requirements;
    • to add value to your property;
    • to make your property easier to sell;
    • to minimise the cost of the extension by extending before the lease falls below 80 years;

    Our solicitors bring technical expertise and a practical approach to this area, acting for both landlords and tenants. Whether you agree private terms to extend a lease or a lease is extended under the statutory rules we can assist.

    In the rare case of a disputed claim for a lease extension our Dispute Resolution team can represent you in the Leasehold Valuation Tribunal.

    Right to manage

    For long leaseholders, poor or overly expensive management of their building by the landlord, or management company, often causes stress and anxiety as well as potential damage to the value of the property. Even for well managed properties many leaseholders would prefer to deal with lease management themselves. In some cases, landlords have become completely absent.

    Leaseholders have started using legislation introduced in 2002 more and more to take over control of the management of the building. The process is subject to technical rules and procedures and will involve forming a new company.

    We are able to assist groups of leaseholders through the entire process from initial consultations and advice, forming the company, serving the claim notice and completing the transfer of the management functions and associated monies being held.

    In addition to heading up our Property team Robert has developed expertise in specialist areas of property practice including residential conveyancing, lease extensions and freehold acquisitions on behalf of tenants, farming and agricultural property law, bank finance and secured lending, and commercial property.

    Robert also advises businesses on commercial leases, sales and purchases of going concerns, and new build development. He is also the firm’s senior responsible officer under its Conveyancing Quality Scheme accreditation.

    His recent high profile cases include the acquisition of a 220 acre mixed residential and agricultural farm site for £6.75m and acting for a borrower taking a £5m loan against a residential portfolio of 44 properties.

    Robert qualified in 2007 and trained with the firm before joining the Property Department, where he worked his way up to become a partner in 2010 and subsequently head of department.
